Terms of Service

1. Acceptance

By downloading, installing, or using NeoXten Terra ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

The App is published by NeoXten Studios, a brand of PLASTYPESA S.R.L., a company registered in Romania (CUI: 52198408).

2. License

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes on Android devices you own or control, subject to these Terms.

You may not:

• Copy, modify, or distribute the App or any part of it
• Reverse-engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Attempt to gain unauthorised access to our systems or other users' data
• Use automated tools to interact with the App (bots, scripts, macros)
• Exploit bugs or glitches for unintended advantage

3. Account and Game Data

The App creates an anonymous account automatically on first launch. You may optionally link a Google account for cloud sync. You are responsible for maintaining the security of your Google account credentials.

Game progress is stored locally on your device and optionally in the cloud via Google Cloud Firestore. We do not guarantee that game data will be preserved indefinitely. We recommend enabling cloud sync to protect your progress.

4. In-App Purchases

The App offers optional in-app purchases through Google Play Billing:

• Nature Pass (Subscription) — available as monthly (€4.99/month) or annual (€29.99/year) plans
• Remove Ads — one-time purchase (€2.99)
• Cosmetic packs — decoration sets, biome unlocks, species variants (priced individually)

Subscriptions

The Nature Pass subscription renews automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription through Google Play > Subscriptions at any time.

Subscription features remain active until the end of the current billing period after cancellation. The base game remains fully playable without a subscription.

Right of Withdrawal (EU)

Under EU consumer law, you have a 14-day right of withdrawal from digital purchases. By initiating a download or in-app purchase, you acknowledge that the digital content is delivered immediately and you consent to waive the 14-day withdrawal period for that specific transaction. Refund requests may be submitted through Google Play.

Pricing

All prices are in EUR and include applicable taxes. Prices may vary by region due to Google Play's local pricing. We reserve the right to change prices with reasonable notice; existing subscriptions will be honoured at the original price until renewal.

5. Advertisements

The App displays optional rewarded advertisements provided by Google AdMob. Advertisements are always player-initiated and never forced. You may choose to watch an ad to receive an in-game reward, or decline without penalty. The App displays a maximum of 5 rewarded ads per day.

6. Intellectual Property

All content in the App — including but not limited to artwork, animations, sounds, music, text, code, game design, and the NeoXten Terra name and brand — is the property of PLASTYPESA S.R.L. or its licensors and is protected by copyright and intellectual property laws.

7. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free from harmful components. To the maximum extent permitted by applicable law, we disclaim all warranties including implied warranties of merchantability and fitness for a particular purpose.

8. Limitation of Liability

To the maximum extent permitted by applicable law, PLASTYPESA S.R.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data or game progress.

Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

9. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by uninstalling it from your device.

Upon termination, your licence to use the App ends. Sections relating to intellectual property, limitation of liability, and governing law survive termination.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Romania, without prejudice to any mandatory consumer protection rights under the laws of your country of residence within the EU.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.
